Flight Delay Compensation

    Terms of Service

    Last updated: April 2026

    1. Who we are

Flight Delay Compensation ("we", "us", "our") is a passenger-rights service that pursues compensation claims under EU Regulation 261/2004 ("EU261") and the UK retained version of that regulation ("UK261") on behalf of our customers ("you").

    2. Our service

When you submit a claim we (a) check eligibility against the regulation, (b) prepare and send the formal claim to the operating air carrier, (c) escalate to the relevant national enforcement body (e.g. the UK CAA) where necessary, and (d) collect any compensation awarded and remit it to you net of our fee.

You authorise us to act on your behalf via a Letter of Authority and Power of Attorney that you sign electronically when starting a claim.

    3. Fees — no win, no fee

Our service is strictly no win, no fee. If we recover nothing, you pay nothing. If we recover compensation, our success fee is 25% (plus VAT where applicable) of the gross amount recovered. The fee and the breakdown of any deductions are shown to you before you sign the authority documents.

If legal proceedings become necessary and the airline is ordered to pay our legal costs, those costs are paid by the airline, not by you.

    4. Your obligations

    • Provide accurate flight, identity and contact information.
    • Forward any communication received directly from the airline about the claim.
    • Not make a parallel claim through another agent or directly while we are acting.
    • Tell us promptly if the airline pays you directly or offers a settlement.

    5. Data protection (UK GDPR / EU GDPR)

We process your personal data as a data controller under UK GDPR and EU GDPR. Full detail of what we collect, the legal basis, retention periods and your rights is set out in our Privacy Policy and Data Rights portal. You can lodge a complaint with the UK ICO or your local EU supervisory authority at any time.

    6. Liability

We use reasonable care and skill to pursue your claim but cannot guarantee a specific outcome — the airline may dispute liability, plead extraordinary circumstances, or become insolvent. Our liability is limited to the amount we would have charged in fees on a successful claim. Nothing in these terms limits liability for fraud, gross negligence, or statutory rights that cannot be excluded.

    7. Cancellation & cooling-off

You have a 14-day cooling-off period during which you may cancel without charge. After 14 days you may still withdraw at any time, but if we have already secured a settlement offer or recovered compensation, our success fee remains payable on the amount recovered.

    8. Governing law & disputes

These terms are governed by the laws of England and Wales for UK consumers and by the laws of Ireland for EU consumers. You can bring proceedings in the courts of your country of residence. EU consumers may also use the European Online Dispute Resolution platform.
